The Democratic Policy and Communications Center published a condensed version of immigration reform of the Group of Eight. The following is the text of the plan to change U.S. immigration laws.

Title I. Border Security

This title establishes border security measures gain and maintain control over high-risk areas in the Southern Border.

Border Plan:

The first stage requires the Secretary of the Department of Homeland Security (DHS for its acronym in English) develop a Comprehensive Border Security and Improvement Strategy The Maya Southern Border Border during the first six months and before the start registration period for the Registered Provisional Immigrant status (RPI for its acronym in English). These strategies should be designed to achieve a persistent patrolling the border and 90% effectiveness of apprehensions and deportations in border areas of high risk. The bill would preempt 3 billion dollars for the development of this plan and will include money earmarked for technology, agents, and other resources.

Conditions:

The border plan must be completely Secretary depending before any RPI can apply for adjustment of status. The Secretary shall develop and implement a Strategy for the Improvement of the Maya Southern Border Border (1.5 billion dollars), E-Verify should be mandatory and operational, and system input-and-output biographical airports and ports sea ​​must be implemented before the RPI to adjust status to permanent resident.

Committee of Governors of the Southwest:

If the specified goals of a 90% effectiveness of persistent fears and border patrols are not satisfied within the first five years, the Commission will establish a Southern Border Security which will make recommendations for achieving these goals. The committee may recommend up to two billion dollars to carry out additional security goals if they are not met.

Additional Resources:

To ensure compliance with these objectives, the resources for Customs Agents and Border Patrol will be increased, will provide additional funds for border processes in the Tucson area, and codify the authority of the National Guard to assist in the operations border security.

DHS Monitoring:

To protect the integrity of the system, additional resources and training will be used to implement a program that trains DHS agents in the use of appropriate force and the impact of federal operations in border communities. There will be a Border Monitoring Group will organize hearings to review and propose changes to border operations. The current functions of the Ombudsman’s Office Citizenship and Immigration Status (USCIS for its acronym in English) will be expanded to cover all DHS immigration functions. DHS must issue regulations against racial discrimination based on individual analysis of the arrests made by DHS agents.

Title II. Legalization (Immigrant Program Registered Provisional) and Immigration Legal

This title provides a path to citizenship for the 11.5 million undocumented immigrants in the United States. Sets a new basis for future legal immigration by reforming family and employment-based, and creates two new programs based on individual merit.

Subtitle A. Creating Immigrant Program Provisional Member

- Registration Requirements: Immigrants who entered the United States before December 31, 2011 and have remained physically in the country since that date qualify to apply for immigrant status Provisional Registered (RPI for its acronym in English) provided if they have no criminal record, have not committed crimes, they must pay taxes, necessary fees, and a fine of $ 500.

- The initial registration will be valid for six years. Dara work permit and permission to travel abroad. Includes spouses and children living in the United States in the same application.

- Renewal: Individuals with RPI status must demonstrate that they have no criminal record, pay the necessary fees, taxes and a fine of $ 500. They must check: 1) who are regularly employed and will not be a public charge, or 2) that have greater financial resources at 100% of the poverty level.

- Adjustment of Status to Permanent Residence: At the end of the period of 10 years, the RPI may apply for adjustment of status, provided they can demonstrate that: 1) are admissible, 2) pay a further fine of $ 1,000 per adult plus a application fee, 3) show that they are learning to speak English, 4) pay taxes, 5) have no criminal record and 6) show that they have jobs. Specifically, to check: 1) who have been employed regularly and will not be a public charge or 2) that have greater financial resources than 125% of the poverty level. Under the reformed immigration system, individuals who have lived in the United States under a legal status may adjust status to permanent resident. This includes RPI and other legal immigrants. The RPI may apply for naturalization after 3 additional years, making the path to citizenship for a total of about 13 years. This bill requires RPI form “at the end of the line”: The RPI can not adjust status until processing all family and employment requests currently being processed and are in arrears.

- Timeline: The Homeland Security Department will have 12 months to promulgate regulations. After these 12 months will be a period of one year application which can be extended up to an additional 18 months by the Secretary.

- DREAM Act: Individuals who entered the United States before age 16 and who have completed high school or obtained a GED in the United States may register to receive RPI status through the DREAM ACT. There is no age limit for this program. Individuals who received deferred action for childhood arrivals (DACA for its acronym in English) will automatically RPI status. The DREAMers with RPI status are excluded from fines and border security conditions. Five years after its initial recording, the DREAMers with RPI status may apply for adjustment of status under the status time RPI count for the requirement for naturalization. This will allow them to become citizens immediately after receiving permanent residency. Children under 16 years will have a path to citizenship for 5 years and will be excluded from certain requirements. The bill will strengthen child welfare protections and ensure that parents are not removed based only on their immigration status.

- Agricultural Program: Agricultural workers who can prove they have worked at least 100 days or 575 hours in the two years before the adoption of this bill, will qualify for a work permit agriculture. Agricultural workers who work at least 100 days a year for five years, or employees who work at least 150 days a year for three years, may adjust status to permanent resident. To qualify to receive permanent residence, farm workers must prove they have paid taxes, have no criminal record, and must pay a fine of $ 400.

- Integration: This creates the Office of New Americans, a support group for new citizens, and initiatives to help immigrants learn English, civics, and integrate into their local communities. Provide funding to help non-profit organizations and local governments to launch programs to help promote these initiatives.
Subtitle B. Legal Immigration Reform
- New Personal Merit Based System: The “first track” creates a visa based on personal merit and placed 120,000 visas annually based on a point system with the potential to increase by 5% (to 250,000) in any year that unemployment This down 8.5%. Points will be awarded according to level of education, type of employment, if you have family in the United States, and the residence time in the United States. Half of personal merit-based visas will be reserved for highly skilled individuals, and the other half for workers with low job training.

- A New “Track II” Based on Personal Merit is created to process all family and employment petitions that are in arrears. Furthermore, this system allows individuals who have lived legally in the country for over 10 years with a work permit to adjust status to permanent resident.

- Spouses and Children of Permanent Residents: The current family categories will be modified to allow spouses and children of permanent residents to immigrate to the country immediately.

- Additional Changes to Current Family System: The category of brothers will be removed 18 months after the adoption of this law. The third family preference category (unmarried adult children of U.S. citizens) will have limit of 31 years old 18 months after the adoption of this law. The backlog reduction program will include the process of requests made in the categories that will be removed. U.S. Citizen siblings may claim up to 18 months after the adoption of this law.

- New Family Visa “V”: Creates a new non-immigrant visa for family members whose applications for permanent residence has been approved. These individuals may live and work in the United States while waiting to receive your card. It also authorizes the visit of relatives, including siblings, to the United States for up to 60 days a year.

- Employment-Based Reforms: Spouses and children of applicants for employment-based visas, graduates in science, technology, engineering, and mathematics (STEM acronym in English), certain professionals, and some doctors are excluded to the maximum number of visas . The limit on the number of visas for low-skilled workers labor will be high.

- Additional Arrears Reduction and Improvements: Additional provisions for quick and arrears reduction include the removal of limits on employment-based petitions and country, up country limits based on family, and the recapture of visa numbers not used. Popular programs for foreign doctors (Conrad 30), religious worker recruitment, and the EB-5 investors are permanently reauthorized. Other technical improvements to modernize visa programs are included (additional protections for stepchildren, widows and other relatives.)

- Judicial Discretion: Expands the authority of immigration judges and DHS to grant exemptions from deportation on humanitarian grounds.
Title III. International Law Enforcement.
This title ordered the mandatory use of E-Verify, creates additional protections for workers, reform the legal immigration system and provides additional measures to ensure compliance with the new law within the country.

- Phase E-Verify In Five Years: The electronic employment verification (E-Verify) cover all American workers, beginning with federal contractors and critical infrastructure employers, over a period of five years. Requires verification of identity through fraud-proof documents. And specifically prohibits the creation of a national identification card.

- Anti-fraud measures: Expands the protections against fraud Social Security number. Allows employees lock your Social Security number, and gives employers access to the history of E-Verify staff workers. Provides an expansion of photo identification mechanism of E-Verify and encourages states to provide photos to DHS.

- Legal Process: Expands legal process protections to prevent legal workers are denied access to jobs employers negligence or errors in the system. Provides retroactive payments to workers who have lost their jobs because of errors in the system or employers. Provides workers with a length of stay after losing his job for the worker correct any errors in the system.

- Labor Protections: Includes protections for employees and employers, including state verification laws, expansion of U visas labor abuse situations, and financing of work programs. It also acts against abuse of hiring.

- Topics on Refugees / Nursing: Streamlines the process of refugee and asylum cases, and eliminates the application deadline a year. Eliminate barriers to family reunification for refugees, authorizes rapid process certain refugee groups at high risk, authorizes agents to extend asylum seekers during asylum interviews, and allows individuals despatriados apply for permanent residence.

- Improvements to Immigration Courts: Authorize an increase in the number of staff in the immigration courts, additional resources, and additional training for immigration judges and other personnel, access to legal advice for vulnerable populations and to improve court efficiency and encodes permanently Immigration Appeals Council, and legal orientation programs.

- Internal Legislation: Hardens certain standards related inadmissibility passport fraud and legal documents, if the individual has been convicted of driving under the influence of alcohol more than 3 times, guilty of being involved with gangs, guilty of domestic violence, abuse child, stalking, violation of protection orders and for failing to register as a sex offender. Prohibits and / or increase the sanctions against smuggling, illegal entry to the country and re-entry. Create a verification system mandatory leave the country.

- Detention Reform: Increase monitoring of detention centers, gives judges the ability to direct immigration bond hearings, and expand alternatives to detention.

Title IV. Reforms to Non-Migrant Programs.

This title reform visa programs non-migrants and creates a new visa Flexibility of work and labor protections with the opportunity to apply for permanent residence.

- H-1B: Changes to the program of H-1B visas for highly skilled workers include increasing the number of visas of 65.000 to 110.000 with the option to increase to up to 180,000 visas per year based on Index High Demand Jobs Training . Lets work authorization for spouses and children. Increase recruitment requirements and offer jobs to American workers before hiring foreign workers. Increase fines and wage requirements for companies using H-1B visas too. After three years, if there are companies that employ more than 50% of its workforce through H1-B visas will be disqualified from the program.

- Prevention of Abuse: Sets new measures and penalties to prevent, detect, and deter fraud and abuse systems H-1B and L-1 Employers fraudulent.

- H-2B: Makes the program permanently H-2B visas.

- New Worker Program (W Visa): Sets a new nonimmigrant classification for low-skilled workers performing services or labor for an employer registered. Spouses and children are included and are authorized to work. This visa lasts three years and has a renewal period of three years. Initially, 20,000 W visas granted and will increase that number to 75,000 in four years. This program will increase the number of visas granted to 200,000 depending on a formula that includes the level of unemployment, job opportunities, number of applications, and the recommendations of the new Bureau of Immigration and Labour Market Research. Employers with labor shortages in your area may hire migrant workers although visas are exhausted. Visas may change employers without having to pay any fine and can apply for permanent residency program based on individual merit or employment.

- Agriculture: Establishes a new visa program for agricultural workers to provide a more stable agricultural job base. Would create a portable work visa without specific employer (W-3 visa) and a work visa with specific employer (W-2). These visas will be administered by the Department of Agriculture and will replace the current program of H-2 A. Provides a quick process for requesting agricultural workers while establishing labor protections. The H-2A program will be dismantled once the new visa program for agricultural workers is fully in function.

- Visa for Entrepreneurs: This project creates a new visa for foreign entrepreneurs who wish to immigrate to the United States to found their companies. This visa lasts for three years and is available to employers who can demonstrate support of an investor in the United States, and has parameters that reflect the number of jobs and income they can generate.

All types of employment discrimination are illegal

WASHINGTON, May 2, 2013 /PRNewswire-HISPANIC PR WIRE/ – There are several ways in which employers can discriminate against job applicants and employees, including denying you a job based on your race, or paying you less money because of your country of origin.

In 2012 there were nearly 100,000 employment discrimination claims filed with the Equal Employment Opportunity Commission (EEOC). Below you’ll learn about some of the main types of employment discrimination and the resources you need to file a complaint.

Discrimination by Race or Color

Race discrimination occurs when an employer treats you unfavorably because of your race. Specifically, employers cannot:

• Deny you employment or harass you at work because of your racial characteristics, including your skin color, facial features, hair type, etc.
• Segregate you from other employees or not allow you to have contact with customers.
• Ask for personal information during a job interview that might reveal your race, and then use this information to deny you employment.

Sex-based Discrimination

• Sexual harassment at work, including unwelcome sexual advances or sexual favors.
• Offensive remarks about someone’s sex or gender identity.
• Unfavorable treatment of women who are pregnant.

Disability Discrimination

People with disabilities have protections under federal laws and cannot be treated unfavorably in the workplace. This includes employees who have a family member with a disability. When it comes to disability discrimination:

• Employers cannot ask you whether you have a physical or mental disability. They can only ask if you are able to perform a certain job.
• Companies must make reasonable accommodations for employees with disabilities.

Age Discrimination

The law protects both job applicants and employees who are of age 40 or older from discrimination at work. For example, employers cannot:

• Advertise age preferences of applicants in job postings.
• Ask about your age during a job interview unless it was made for a lawful purpose.

Discrimination by National Origin

People born abroad who have authorization to work in the United States have the same rights and opportunities as everybody else. Employers cannot:

• Fire, suspend or deny you employment to because of where you were born.
• Treat your unfavorably because of your foreign accent or your ability to speak English.
• Mandate you to speak English only at work (unless it’s done for non-discriminatory purposes).

The history of this huge country records a peculiar case in which they were involved President Andrew Jackson (No.7 President of the United States who was called “the old hickory”, which means “old oak tree” for its long-standing since the war of 1812, Mr. George Wilson, James Porter and the Supreme Court, then headed by John Marshall, famous for being the Supreme Court Judge for 34 years, seeing six different presidents parade.
It turns out that Wilson and Porter committed the serious crime of stealing mail in the State of Pennsylvania in 1829. Having been found guilty of six charges, including the steal-mail, something very serious – and have endangered the life of the postman. Both men were sentenced to be hanged, which sentence was carried out a year later, in 1930.
The case takes an unexpected turn, as one of them, James Porter, was executed on the date that was set. But George Wilson, had influential friends who interceded for him before President Andrew Jackson, who was granted a presidential pardon in such a case the offender would spend only 20 years in prison, instead of death by hanging.
But in an unusual way, George Wilson refused the pardon of President Jackson. The condemned man was taken back to court to force him to accept the pardon which he refused flatly. The case reached the Supreme Court.
Records the history that Justice John Marshall, gave a statement that among other things said:
“Forgiveness is a grace from the power charge of executing the laws, and that frees the individual that is granted, the penalties imposed by law for having committed an offense or crime,” adding further that such forgiveness, had to constitute an act of surrender to forgive, and that no delivery is completed, if there is “acceptance”.
George Wilson, chose to die, and was executed, instead of accepting the pardon of President. Any of us would think that this man is a fool to turn down the opportunity to continue living.
Similarly, God gives us the forgiveness of our sins, rather than spend eternity separated from Him But for this forgiveness, to be valid, like that of George Wilson, has to be accepted, and more importantly accept the giver of Atonement, as the only Savior of our lives.

Wilkes University’s Spanish 398: Culture Through Literature class is using Dr. Paola Bianco Sobejano recently published, “Conversando con literatura,” to discuss universal topics and further discuss the Hispanic culture.

“I think it has been very beneficial to us because it exposes us to many different topics, and we are able to interact with the author who put everything together,” Ally Kristofco, a junior at Wilkes said.

The book by Bianco Sobejano, an associate professor of foreign language at Wilkes University, contains 14 chapters. Each chapter is structured with a photo, an introduction section, and then a literary topic, text, short story, poem, song or photograph relating to the chapter.  The photo linked to each chapter allows students to express their view.

The introductions are a combination of Sobejano’s research, which she conducted during her yearlong sabbatical, and her personal analysis. The literary works that follow the intro are used as supporting evidence.

During the three-years it took Bianco Sobejano to put together the book, she interviewed authors in Costa Rica, España, and Chile. She also conducted research at Madrid’s national library, along with Cornell’s library, and accessed interlibrary loans and other university’s sources.

Sobejano said some of the chapters consist of human rights, memories of childhood, beauty and youth, and euthanasia.

The chapter, “Memories of Childhood”, has a psychological aspect to it, allowing the reader to analyze childhood memories from an elder’s perspective as well as a child’s.  This topic is easy for the reader to relate to since each reader has experienced his or her own childhood memories.

“My favorite chapter so far has been Recuerdos de la Niñez (Memories of Childhood),” Kristofco said. “I found that chapter very interesting because as children we can’t wait to grow up and as we get older we wish we were young again.”

“Beauty and Youth”, another chapter, goes back to Plato and what he considers as beauty. From Plato’s description Bianco Sobejano analyzes beauty in relation to Cleopatra and the rubenesque figure. And completes the introduction by touching on modern society’s perception of beauty and how it has developed eating disorders and plastic surgery.

Although the publication of the book took longer than Bianco Sobejano had anticipated, she said she is glad that it is finally complete and proud to be able to see it used within her very own classroom. “Conversando con literatura” will be available for use in various American-Canadian universities.

“Wilkes University’s faculty is expected to engage in scholarship,” Dean Linda Winkler, of college arts, humanities, and social science, said. “It enriches the community.”

Winkler pointed out the importance of Bianco Sobejano’s active involvement within the Wilkes community. As coordinator of the study abroad program and faculty adviser of the Spanish club.

“Faculty’s scholarship beyond the classroom exposes students to liberal arts and things that excite us,” Winkler said.

Preheat oven to 375 degrees F.
Grease a 9 x 13-inch baking pan.
Line baking pan with flour tortillas up even with edges of pan.
Brown ground beef and onion.
Add tomato sauce and taco seasoning mix to browned meat. Stir mixture well.
Pour ground beef mixture over tortillas in pan.
Sprinkle with Cheddar cheese.
In a blender, mix together milk, eggs and Bisquick for 15 seconds or with
hand beater 1 minute.
Pour batter over beef and cheese mixture.
Bake 35 to 40 minutes. Let stand 10 minutes before serving.
Serve with chopped tomato, shredded lettuce and sour cream, if desired.
